C15. Passports &Visas (British Citizens) and Health Requirements

It is your responsibility to ensure that you and all those travelling with you have a valid passport and any necessary visa and that you have obtained any necessary vaccinations to gain entry to any country you are visiting. It can often take some time to obtain a passport or visa therefore you should apply well in advance. In peak periods it is advisable to allow at least 4 weeks. General information on passport and visa requirements for British Citizens is available through our website or within the details sent to you. However, passport and visa regulations and health requirements can change at any time, therefore, we recommend that you check passport/visa requirements with the Embassy or Consulate of the country you intend to visit and that you consult your GP or the Foreign Office (www.fco.gov.uk) regarding health requirements or visit websites such as www.nathnac.org.uk and www.hpa.org.uk for information. We will have no liability to you if you or any member of your party travel without the correct passport and visa or without the necessary vaccinations, and you will have to pay to us any costs which we incur through helping you because of any such failure on your part.

C16. General Information

Joint Services: Please note that two airlines may share the same services; therefore a flight may not be operated by the airline whose designated code is shown on your itinerary and ticket.

Taxes: We will advise you of all mandatory taxes, which you must pay before departure. However, many countries charge departure taxes that can only be paid locally. It is therefore recommended that you retain sufficient local currency to meet such charges. Details of departure taxes can be obtained from the relevant airline when you reconfirm your flight details.

C17. Acceptance of Risk

The nature of the Activities and holidays that you book is adventurous and participation involves a degree of personal risk. You recognise that many Activities, such as rafting, climbing, biking, trekking and cultural tours are activities with a danger of personal injury or death. By entering a contract with us, you accept these risks and you are responsible for your own actions. Although the Tour providers we use take every care to minimise these risks, your booking is accepted by us on the basis that you understand and accept the risks involved in outdoor activities.
You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in your daily lives. You accept that you are travelling to areas where, amongst other things, the standard of accommodation, transport, safety, hygiene, cleanliness, medical facilities, telecommunications and infrastructure may not be of the standard you are used to at home or on conventional holidays. The Tour providers use information from government foreign departments and reports from their own contacts in assessing whether the itinerary should operate. However it is also your own responsibility to familiarise yourself with all possible relevant travel information and the nature of your itinerary. You accept that your decision to travel is made in light of consideration of this information and you accept that you assume the personal risks associated with such travel.

C18. Flexibility

The nature of outdoor, Tours, activity courses and holidays require the need for you to be flexible and be prepared for changes without prior notice as the organisers of activities need to be able to adapt quickly to changes in local conditions and situations. The day-to-day objectives and overall aim for any Activities and Tour holidays is only intended as an indication or guide of what you may be able to accomplish but is not a contractual obligation on the part of Neilson. The itinerary provided for each trip is representative of the types of Activities contemplated, but you accept that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
Where delays and alterations to holidays occur after you have departed we and our suppliers will act reasonably to make suitable alternative arrangements where possible. We will not be responsible for any inconvenience, discomfort, or disappointment, where changes are necessary due to circumstances beyond our control or the control of our suppliers, or where alterations are made in the best interests of your safety and welfare.
In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by you: please refer to the description of your trip for details of Emergency Funds which you agree to carry, to be used in such instances.

C19. Authority on Tours

Neilson use the services of specialist Tour providers who appoint group or tour leaders to represent the Tour provider. The leader has responsibility to maintain authority over the group during the holiday. You accept the leader has the relevant authority and the decision of the leader is final on all matters likely to affect your safety or well-being. The decision of the leader as to the conduct, itinerary and objectives of the tour is final.
The safety, welfare and wellbeing of the group as a whole are the leaders paramount consideration. If, in the opinion of the leader;

• your actions or behaviour (such as the failure to comply, or interference with a decision of a group leader);
• your physical condition or a medical condition;
• your general wellbeing

is detrimental to the safety, welfare and well-being of the group, or if it is causing or likely to cause danger, distress or annoyance to yourself or to others, or if the leader considers your general wellbeing will be put at risk by continuing with the holiday, you may be asked to leave the tour without the right to any refund for unused services and without any liability on our part.
You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.
If you are unable, or choose not to complete an itinerary or Tour outlined for a holiday, Neilson and/or the Tour provider is not liable to supply alternative itineraries, excursions, accommodations, services or staff for the period when you are not present with the group.

C20. Disabled Travellers or Customers with Reduced Mobility or Medical Needs.

We welcome people with restricted mobility, medical or particular care requirements or a disability, and aim to ensure that our services are as accessible as reasonably possible to all. The majority of overseas accommodation, overseas transport (including transfers) and other holiday services provided overseas are not equipped to cater for the needs of many disabled holidaymakers. However, in order that we may provide accurate information to you, it is important that we are fully informed of any needs, requirements and conditions before any booking is concluded. Please telephone us and we will be happy to discuss availability, suitability and potential reasonable adjustments with you, including any requirement for you or a member of your party to be accompanied by someone who is able to provide for any particular needs you or they may have, over and above any reasonable adjustments we are able to make.
If you have special requirements a risk assessment might be required prior to confirming a booking or allowing participation in certain activities. Please note that we rely on the information you provide to help us anticipate and satisfy your needs. We therefore require you to give us a full description of your needs. You must update us with any change in your circumstances prior to and during your stay. The group leaders can only provide general first aid. As such it may be necessary for you or a member of your party to be able to administer or attend to your/their own medical needs or have someone accompany you/them who can do so.
You should inform us immediately if, within 4 weeks prior to your arrival date or during your break, any member of your party has, or develops, an infectious or contagious medical condition. If so, we have the right to

- refuse to accept your booking;
- cancel your holiday; or
- ask any member of your party to leave immediately, should we, at our reasonable discretion, consider it necessary to protect the health of others.

It is your responsibility to ensure that you are sufficiently fit and healthy to complete your chosen holiday. We reserve the right to require you to produce a doctor’s certificate of fitness to participate in your chosen holiday. If you are affected by any condition, medical or otherwise, that might affect your or other people’s enjoyment of the holiday, you must advise us before booking. If you do not do so, we may cancel your holiday at any time.

Flights

If you or a member of your party are a wheelchair user or have reduced mobility we strongly advise that you contact us directly or your travel agent before making your reservation. This will enable your travel agent to confirm with us or the airline and airport the availability of any assistance requirements prior to booking, as any changes made after booking will be subject to our standard change fees.

C21. Clothing, Equipment and Spending Money

You are responsible for bringing with you the proper clothing and equipment, which we advise you about on our website and in the itineraries / pre departure pack. Any information given by Neilson in regard to climate, clothing, special equipment, etc is done so in good faith and must be rechecked by you prior to relying on it. Some Tour providers also require you to contribute a specified amount of money into a kitty and/or towards an emergency fund for use when overseas. Details will be provided in the descriptions of the Tour holiday.

C22. Special requests

If you have a special request for anything that is not automatically part of the travel arrangements you book through us, please advise us when you book and we will pass this information on to the companies we work with. Our note of your request on your invoice/receipt confirms we have received it and does not guarantee that we, or the relevant supplier, can meet with your request. Where possible they will try to help you, but we cannot guarantee any request unless it is noted on your invoice/receipt and we also confirm the request separately in writing. We must emphasise that verbal confirmations of special requests cannot be taken as a guarantee that they will be met e.g. special meal types on flights, or hotel room or Cruise Ship state room number requests. We will not pay compensation for failing to meet a special request that we have not confirmed separately in writing

C23. Excursions and/or Optional Activities

Excursions or Optional Activities include, but are not restricted to, any sightseeing trips, events, activities or other tours for which additional payment is required and/or which do not form part of the itinerary of your trip. Excursions or Optional Activities can either be booked and/or paid for when overseas or pre-booked and paid for when you book your Package with us ("Pre-booked Excursions"). All Excursions or Optional Activities are supplied by third party suppliers and are subject to the section entitled "Suppliers' Conditions" above. We accept, subject to the Sections entitled "Suppliers' Conditions" and "Our Liability to You" above, responsibility for Pre-booked Excursions. However, Overseas Booked Excursions or Optional Activities do not form part of your Package and are not governed by the Package Travel, Package Holiday and Package Tours Regulations 1992. We do not have any responsibility or liability whatsoever for anything which may go wrong on an Overseas Booked Excursion and/or Optional Activity. In any event the contract for any Overseas Booked Excursion or Optional Activity is between you and the operator/provider of the Overseas Booked Excursion or Optional Activity. It is your responsibility to note carefully any conditions of contract contained in any Overseas Booked Excursion or Optional Activity, literature, ticket or receipt you are given. For Overseas Booked Excursions or Optional Activities you may be subject to the laws of the country in which you take your excursion or activity and may be required to bring any disputes or claims before the Courts of that country also.

C24. Flight Detail

If it is possible, at the time of booking, to provide details of the type of aircraft, which will be used, we will provide you with these. However, it is not possible to guarantee that this is the type of aircraft which will be used because this may change.

C25. Information Accuracy

Descriptions of accommodation, facilities, activities, services and itineraries we provide are based on information obtained from our suppliers. Sometimes the facilities described will be withdrawn for reasons such as maintenance, bad weather or lack of demand from guests. Where our suppliers advise us about significant changes to descriptions or about the withdrawal of any significant facility, we will tell you as soon as possible.
Some activities or facilities may not be available all year round. There may be a charge for some facilities, for example, TVs, hiring equipment, safety deposit boxes, saunas, and air-conditioning. In some places during high season (and even at other times) there is a possibility you will be disturbed by noise from less considerate groups, so please bear this in mind when choosing your destination and accommodation. Any transfer times we quote for travel between airport and resort are approximate and, depending on circumstances, the journey time to your own chosen property may be longer.

C26. Personal Information

We will provide your personal information, as well as any personal
information you provide in relation to those other persons who form your booking party, to suppliers and carriers who might be located outside the UK and/or EU, to enable the operation of the services requested by you. If you make special requests, which include, but are not limited to, special dietary, religious or disability-related requirements, which constitute sensitive information, the relevant data will also be passed to the relevant suppliers and carriers to enable provision of the services to you.

C27. Your Responsibility

We want all our customers to have an enjoyable and carefree trip. But you must remember that you are responsible for your actions and the effect they may have on others. If we (or another person in authority) believe your actions could upset other customers, our suppliers or our own staff, or put them in danger, your holiday / travel arrangements may be ended and this could mean we or our suppliers may either ask you to leave your booked accommodation, or prevent you from boarding the aircraft. Our suppliers will deny boarding or impose additional conditions of carriage on any passenger who, for example, is intoxicated and/or disruptive or found to be smoking on board the aircraft. If this happens, we will not pay compensation, make refunds, or cover any expenses you suffer as a result.
If your behaviour or the behaviour of any members of your travelling party causes any aircraft or Cruise Ship to be diverted we and/or the carrier will hold you and those members jointly and individually liable for all costs incurred as a result of that diversion.
We cannot accept liability for the behaviour of others in your accommodation, tour group or flight, or for any facilities/services withdrawn as a result of their action.

C28. Law and Jurisdiction

Your contract will be governed by English law and any disputes will be dealt with in the courts of England and Wales. If you live in Northern Ireland or Scotland, the courts of Northern Ireland or Scotland (as appropriate), can deal with any disputes.
